Terms of Service

These Terms govern your use of the Streak Hunter mobile application (the "App") provided by Eswarden ("we", "us"). By installing or using Streak Hunter, you agree to these Terms. If you do not agree, do not use the App.

1. Who can use Streak Hunter

You must be at least 18 years old to use Streak Hunter. The App addresses topics — addiction, recovery, substance use, gambling — that are not appropriate for minors. You also need to be legally able to enter into a binding contract where you live.

2. The App is a self-help tool, not medical care

Streak Hunter is a self-tracking and self-help tool. It is not a medical device, is not intended to diagnose, treat, cure, or prevent any condition, and does not provide medical, psychiatric, psychological, or therapeutic advice. Information shown in the App — including the "health timeline", monetary savings estimates, and any educational content — is general information based on publicly available research and may not apply to your situation.

If you are in crisis, in withdrawal, or struggling with a substance-use disorder, an eating disorder, gambling, or any mental-health symptom, please contact a qualified professional or your local emergency services. Do not rely on the App in place of care.

3. Your account

You sign in with Apple or Google. You are responsible for keeping access to that account secure. Tell us at support@eswarden.com if you believe your account has been compromised.

You may have only one account. Do not impersonate another person or pretend to be Eswarden.

4. Subscriptions, trials, and refunds

• Streak Hunter offers a free tier and an optional Hunter's Oath subscription (monthly or yearly). Current prices and trial lengths are shown inside the App and on the product page.
• Subscriptions are auto-renewing. They renew at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends, in line with the App Store / Play Store rules.
• Free trials, where offered, convert to a paid subscription automatically unless cancelled before the trial ends. Each Apple ID or Google account is generally eligible for one trial.
• You manage and cancel your subscription from your Apple ID → Subscriptions or Google Play → Subscriptions. Deleting the App does not cancel a subscription.
• Refunds are handled by Apple and Google according to their own policies. We do not process card refunds directly. For App Store refunds: reportaproblem.apple.com. For Google Play: refund flow inside the Play Store.
• If your subscription ends, any extra hunts beyond the free-tier limit will be paused (not deleted) until you renew.

5. Acceptable use

When you use Streak Hunter, you agree not to:

• Use the App to harass, threaten, or harm another person — including through your hunter name, avatar, or any text visible on shared cards or leaderboards.
• Upload sexual content involving minors, hate speech, or content that promotes self-harm or illegal activity.
• Attempt to game leaderboards, fabricate streaks, or use bots or automated scripts against the App's backend.
• Reverse-engineer, decompile, or attempt to extract source code, except to the extent the law permits.
• Use the App in violation of any export-control or sanctions law that applies to you.

We may suspend or close accounts that break these rules.

6. User-generated content

You keep ownership of the text and images you create in the App (relapse notes, "why" notes, journal notes, custom hunter name, avatar). You grant Eswarden a worldwide, royalty-free, non-exclusive licence to host, transmit, back up, and display this content solely to run the App for you — for example, syncing it to your other devices, showing it on a shared card you choose to export, or showing your hunter name to a friend you have connected to on a leaderboard. We do not use your content for any other purpose.

7. Intellectual property

The App, the Streak Hunter brand, the sigil, the monster artwork, copy, sound, and code are owned by Eswarden or its licensors and are protected by copyright and trademark law. The App also includes open-source components (e.g. OpenMoji art under CC BY-SA 4.0); attributions are listed in the App under Settings → About → Acknowledgements.

8. Privacy

Your data is handled according to our Privacy Policy, which is part of these Terms.

9. App Store terms

If you downloaded Streak Hunter from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement (the "Standard EULA"), which applies in addition to these Terms. To the extent of any conflict between the Apple Standard EULA and these Terms, these Terms control, except where Apple's terms require otherwise. Similar terms apply for Google Play.

10. Beta & preview features

From time to time we may release features marked "beta", "preview", or "experimental". These are provided as-is, may change without notice, and may be removed.

11. Disclaimers

To the maximum extent allowed by law, the App is provided "as is" and "as available", without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any data will always be preserved (please keep your own backups via the export feature for anything you cannot bear to lose).

12. Limitation of liability

To the maximum extent allowed by law, Eswarden and its officers, contractors, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to these Terms or your use of the App will not exceed the greater of (a) the amount you paid us in the 12 months before the event that gave rise to the claim, or (b) USD 50.

Nothing in these Terms limits liability that cannot be limited by law — for example, liability for fraud, gross negligence, or death or personal injury caused by negligence.

13. Indemnity

You agree to indemnify and hold Eswarden harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the App.

14. Termination

You can delete your account at any time from Settings → Account → Delete account. We can suspend or close your account if you break these Terms or if we discontinue the App. If we end your access without cause, we will refund any unused portion of a prepaid period through the App Store or Play Store, where they support it.

15. Changes

We may update these Terms when the App changes meaningfully. We will show a notice in-app at next launch when we do, and update the "Last updated" date above. Continued use of Streak Hunter after that point means you accept the new Terms.

16. Governing law & disputes

These Terms are governed by the laws applicable at Eswarden's principal place of business, without regard to conflict-of-law rules. The courts at that location have non-exclusive jurisdiction over any dispute. If you are a consumer in the European Union or the United Kingdom, you keep the benefit of any mandatory consumer-protection rules in your country of residence. The European Commission's online dispute-resolution platform is available at ec.europa.eu/consumers/odr.
