One short page covering both privacy and terms for every Eswarden app — Hespera, Tether, and Noctuary. By using an app, you agree to what’s below. We’ve kept it plain on purpose.
The short version
- We don’t sell your data, and we never run ads.
- We collect the minimum needed to run the app and sync it across your devices.
- You can export or delete everything from Settings → Account, any time.
- Subscriptions are optional, honest, and cancellable from your phone in two taps.
- Your private content (dreams, messages, notes) stays yours. We don’t read it.
Who we are
ESWARDEN LLC — a limited liability company registered in Georgia (company ID 445851374) — trades as Eswarden, publishes these apps, and is the controller of the data they process. Reach us at hello@eswarden.com, or for data questions, privacy@eswarden.com. We answer data requests within 30 days.
What we collect
- Account — a sign-in (Apple, Google, or email), a display name, and basic preferences like timezone and theme. We never see your Apple or Google password.
- Your content — what you create in the app: sleep check-ins and feedback (Hespera), shared moments (Tether), or dreams and collages (Noctuary). Stored against your account so it syncs and survives a reinstall.
- Diagnostics — crash reports and coarse, anonymous usage counts so we can fix what breaks. Never your private text.
- Subscription state — whether a subscription is active, via Apple, Google, and RevenueCat. We never see your card number.
What we never do
No selling or renting your data. No ads or advertising identifiers. No reading your private free-text content. No precise location, contacts, calendars, or microphone access. No feeding your content into third-party AI training. We don’t track you across other companies’ apps or websites — which is why the apps never ask for tracking permission.
Where data is processed
We use Google Firebase (sign-in, storage, crash reports), RevenueCat (subscriptions), and the Apple App Store / Google Play (payments and sign-in). Noctuary additionally sends dream text to OpenAI, server-side, only to paint your collage — it is not used to train their models. These providers may process data in the United States.
Each of them is bound by a data-processing agreement to protect your data at least as strongly as this page promises, to use it only for the service we asked them to perform, and never to sell it. Their own policies: Firebase, RevenueCat, OpenAI, Apple, Google. If we add another provider, we’ll update this page first.
Export, delete & withdraw consent
Open Settings → Account to export your data as a file, or to delete your account — deletion is available inside every app, no email required. When you delete, data tied to your account is removed within 30 days (Tether keeps a short re-pair window for a couple’s shared data). You can also write to privacy@eswarden.com from your account address for a copy or a deletion.
Anything you opted into — notifications, diagnostics sharing, Noctuary’s collage generation — can be switched back off in Settings at any time, and switching it off stops that processing from then on. Withdrawing consent doesn’t affect what was lawfully processed before.
How long we keep it
- Account and your content — while your account exists; erased within 30 days of deletion.
- Diagnostics and crash reports — up to 90 days, then discarded.
- Subscription and purchase records — held by Apple, Google and RevenueCat under their own retention; we keep only the on/off state of a subscription while your account exists.
- Backups — rolling, overwritten within 30 days.
Children
These apps are not directed at children. You must meet your country’s minimum age for consent to data processing (16 in much of the EU, 13 in the US and UK) and the App Store or Google Play minimum age. We don’t knowingly collect data from anyone younger; if we learn we have, we delete it. Write to privacy@eswarden.com if you believe a child has created an account.
Subscriptions, trials & refunds
- Each app has a free tier and an optional subscription. The title, length and price of each period are shown in the app before you buy, in your local currency.
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions auto-renew at the same price unless you cancel at least 24 hours before the current period ends; the renewal is charged within those last 24 hours.
- Manage or cancel from Apple ID → Subscriptions or Google Play → Subscriptions. Deleting the app does not cancel a subscription.
- If a free trial is offered, any unused part of it is forfeited when you buy a subscription covering the same period.
- Refunds are handled by Apple and Google under their policies — we can’t charge or refund cards directly. Apple: reportaproblem.apple.com.
Using the apps
Please don’t use our apps to harass or surveil anyone, upload illegal content, abuse leaderboards, or break the law. Tether in particular only works with the genuine, freely-given consent of both partners — never use it to track someone without their knowledge. We can suspend accounts that break these rules. You need to be old enough to agree to these terms where you live and to meet the App Store / Google Play minimum age.
Your content stays yours
You keep ownership of everything you write or upload. You give us only the permission needed to host, sync, and display it back to you (or, in Tether, to your paired partner). That’s it.
Health & wellbeing
These are self-help, planning, and keepsake apps — not medical devices, and not a substitute for professional care. Hespera helps you plan sleep and notice patterns but does not diagnose or treat sleep disorders. Noctuary reflects patterns in your dreams but never hands down a clinical “meaning.” If you’re struggling, please reach out to a qualified professional or a local helpline alongside the app.
As-is, and our limits
The apps are provided “as is.” We work hard to keep them reliable, but we can’t promise they’ll be perfect or never lose data — please keep your own export of anything you can’t bear to lose. To the extent the law allows, our liability is limited to what you paid us in the past year (or USD 50, whichever is greater). Nothing here limits liability that can’t be limited by law.
If you got the app from Apple
These terms are between you and ESWARDEN LLC only — not with Apple. Apple is not responsible for the apps or their content. Specifically:
- Your licence is a non-transferable licence to use the app on any Apple-branded device you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the apps.
- If the app fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform are ours to handle, not Apple’s.
- We — not Apple — are responsible for addressing any claim from you or a third party about the app, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, claims under consumer-protection or privacy law, and claims that the app infringes someone’s intellectual property.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes
If we change anything meaningful, we’ll show a notice in-app and update the date above. Continued use means you accept the update.
